My friend has a month left in her pregnancy and she is thinking about signing her rights over to me and my husband. Is that possible without having legal fees or anything?

Since it is regarding the guardianship or custody of a child, I’m sure some legal procedures will have to take place. Since this sounds like a private adoption, your fees probably won’t be as much, depending on where your are.
I’d say find a lawyer that would be willing to give you some free consult to see what your options are then go from there. ಌSelph-Tytl’dಌ
dunno. but why is she doing this? this is her baby, she cant just randomly decide to give ‘it’ to you. and if you are her friend you will encourage her to KEEP her baby. tell her not to think about adoption until after she has had her baby and discourage her from doing this cos she will regret it.
your wording just makes the situation seem a bit strange. “month left in her pregnancy and she is thinking about signing her rights over”. Susan
no, it would never happen. she could give legal guardianship to someone else but there is no such this as signing rights over. The bio parents name will still be on the birth certificate though. Molly
Yes she def can. She can sign over rights and name you as the childs legal guardian without you officially adopting the children. Legal fees are not necessary. I took guardianship of my god daughter. The mother wrote a letter stating her wishes, went to court(you can request a fee waiver if your strapped for cash) and it was quick and simple. You actually don’t even need to go to court unless you’re trying to get public assistance. Phoenix S
She could give you legal guardianship but that is still a court ordered arrangement. You have to go into court and be represented by an attorney. cricketlady
No, it just doesn’t happen that way. You can’t just “give” children away. Adoption/guardianship makes it legal. You DON’T want to end up on Nancy Grace do you?? Pretty Kittys Gt Klaws (=^_^=)
This is called a consented adoption. You would have to have the approval of the child’s father as well. There are legal fees to adoption. Mine were covered because it was a foster placement. But it was a consented adoption. The birth mom was about to have her rights terminated and wanted to be sure the children stayed with me. The fathers of each of the children also signed consents. The consented adoption avoided the termination of parental rights for her, which was going to happen. Its a difficult decision for the birth parents and the adoptive parents. Be sure this is what you all want. We have an open adoption and contact with the birth mom and it has been wonderful. Its been 7 years since they were placed and 4 years since the adoption of the three children. HoosierGal33

Not as far as I know.
