		<description>I think that the mother is being very selfish &#038; should let the father have the child. then maybe he could let her visit if she pays child support. however, if the father finds the other family can care for the child, it would be big of him to let go.</description>

If the mother is choosing to give a child up and then decides to change her mind So he doesnt get the baby, That just doesnt seem right.</description>

		<description>I know a guy that this happened to at the beginning of this year.  He found out that his ex-girlfriend, who had told him that she was having an abortion, didn't have the abortion.  He found out 2 weeks before the baby was born and he immediately started legal proceeding in order to get custody of his child.  The mother had the baby 1 week early and they took the baby to the adoptive family.  

The father fought like crazy to get his son.  The adoptive family wanted a totally closed adoption.  When the nfather got a court order to be able to see the baby, the adoptive family got very angry.  They decided after 3 months that they did not want to adopt this baby because they wanted the nparents totally out of the picture.  The nafather was very happy, thinking that he was to get custody.  When he went to the court proceeding he brought everything that he would need to bring the baby home and instead the judge gave the baby back to the nmother.  The nfather gave her all of the things he had brought because she had come totally unprepared to take the baby home.  

This situation is still on going but it appears that the nmother will be keeping the baby even though she had already signed her rights away.</description>

		<description>It would depend upon who the judge sees as the better custodial parent for the child (more stable, better prepared, time available, etc). Certainly the fact that the mother was in the process of trying to give up guardianship of the child, as well as her intentions to keep this from the childs father will play into how the judge sees her behavior. However, I don't think that would necessarily make her a lesser choice for the custodial parent, especially if she shows good reasoning behind her decisions (such as not being able to care for the child properly w/o the fathers voluntary involvement). At the very least, my guess would be that the judge would decide upon joint custody if the mother and father we're both adequately capable.</description>
