This would heavily depend on if any paper work is even drawn up between u or not. If she can get an attorney- or u can have one on stand by just for this- to get to the hospital after the birth then it should all be ok! BUT please make sure that you have a lawyer who is dependable and someon u can count on to be there at a seconds notice! Have him go ahead and prepare a document for you so that you will have it just in case! Dont chance it! The DHS will take the child if there are no papers signed and it will be much harder to asdopt from them! Good luck on this I truly hope it all works out for u

your homestudy has to be done prior to birth/placement.

She can't pick you to adopt if you are not ready, the child will go to Social Services unless she picks a family who is already homestudy approved and ready to adopt. Once the child is in Social Services, it will be hard and almost impossible for you to get that child.

Good Luck!

i feel your pain of not being able to have children but if this girl is not going jail for a long time then maybe it wont be fair to adopt the baby rather keep it for her until she comes back i think that the fact that she has'nt signed anything proves that she loves her baby i think that its only fair for any parent to be given the chance to raise their own child, as for problem keep on praying and one day god will show you miracles good luck with everything and god bless you for having a good heart.

I don't know how it works in your state, but here, the baby would probaby go into foster care until all the paperwork is completed. It might be possible for the birth mother to formally declare you guardians, but she'd have to do that through her lawyer. However, that would bypass social services for the short term and you may be able to bring the baby home immediately. Here, if birth mom gave you custody, then you could take the baby home and social services would work to make you foster parents on an emergency track. That's not to say you'd be regular foster parents, but you'd be legally able to care for the baby with whom you've been entrusted. Definitely, definitely talk with legal counsel and birth mom now, or it's very likely you'll be swept away in the system.
